The Australian Government announced the Net Zero in Government Operations Strategy in 2023, supporting its pledge to achieve net zero emissions within the Australian Public Service by 2030. The Strategy outlines key actions to reduce carbon emissions across various sectors such as buildings, energy, procurement, fleet and travel. Finance is establishing Whole of Australian Government co-ordinated procurement arrangements for electricity services on a state and territory jurisdictional basis. This Request for Tender aims to consolidate separate Commonwealth entities' large market electricity services contracts into a comprehensive Arrangement in the Australian Capital Territory, for entities to procure electricity.
At the Closing Time, the Tenderer must: (a) be a legal entity recognised under Australian law; (b) not be bankrupt or insolvent; (c) hold Valid and Satisfactory Statements of Tax Record for the Tenderer’s entity type; (d) hold Valid and Satisfactory Statements of Tax Record required for the entity type of any first tier subcontractor that it proposes to engage (as part of its Tender) to deliver goods or services as part of a contract resulting from a procurement with an estimated value of $4 million or more (GST inclusive); (e) not be subject to any judicial decision against them (not including decisions under appeal) relating to employee entitlements (or if subject to such judicial decision, the Tenderer must have satisfied any resulting order); (f) not be listed as a non-compliant employer under the Workplace Gender Equality Act 2012 (Cth); (g) hold and maintain an Electricity Retailer’s Authorisation or Licence issued by the Australian Energy Regulator. A contract resulting from this tender can only be signed with a Licenced or Authorised Retailer.
For reasons of confidentiality and subject to paragraph 7.5 of this RFT, the Due Diligence Information will not be made available to Tenderers until ALL documents of Attachment E – Tender Registration Documents comprising: (a) Deed Poll; and (b) Tender Registration Form are correctly completed and duly executed, and provided to the Contact Point actelectricity@finance.gov.au any time throughout this ATM.
