Subject to clause 5.7 of CSIRORFT2025024 Head Document, Unintentional Errors of Form, CSIRO will exclude a Tenderer from further consideration and evaluation if CSIRO considers in its absolute discretion that the conditions for participation set out in this clause have not been met by the Tenderer. Notwithstanding anything else contained in this RFT, only requirements listed in this clause will be deemed conditions for participation. a. the Tenderer exists as a legal entity at the RFT Closing Time and Date b. at the time of lodgement of their Tender, Tenderers must not have been: i. precluded from tendering for Australian Government funded work or ii. subject to a judicial decision against them relating to employee entitlements (not including decisions under appeal, and have not paid the claim c. where the Tenderer is a Relevant Employer, the Tenderer is compliant with its obligations under the Workplace Gender Equality Act 2012 (Cth) (the WGE Act). Further information may be found at http://www.wgea.gov.au/ d. the Tenderer must comply with all Mandatory Requirements identified in the Attachment A - SOR (Statement of Requirements) e. the Tenderer will be required to hold all Valid and Satisfactory Statements of Tax Record: i. required for its entity type; and ii. required for the entity type of any first-tier subcontractor that it proposes, as part of its response, to engage to deliver goods or services as part of a contract resulting from a procurement with an estimated value of $4 million or more (GST inclusive). f. Tenderers (including new businesses and foreign Tenderers) are required to provide evidence of their compliance as specified in Schedule 3 item 1.3.4 of Attachment B - TRS (Tender Response Schedules) and successful Tenderer/s must provide a Valid and Satisfactory Statement of Tax Record/s prior to the award of a Contract. g. It is a requirement of this project that the Builder/s contracted to undertake the building work be accredited under the Work Health and Safety Accreditation Scheme, established under the Federal Safety Commissioner Act 2022, at the time of entering into the contract for the building work and while the building work is being carried out. The Builder/s must comply with all conditions of Scheme accreditation. h. Tenderers should note that the Environmentally Sustainable Procurement Policy applies to this RFT. The Environmentally Sustainable Procurement Policy aims to improve environmental sustainability across three focus areas: climate; the environment; and circularity. i. Tenderers are to note that the Australian Skills Guarantee Procurement Connected Policy applies to this Approach to Market. Tenderers are required to comply with the Australian Skills Guarantee Targets in the delivery of any resultant contract for this procurement. j. Tenderers should note that subject to advice from the Department of Industry, Science and Resources, the Commonwealth Australian Industry Participation (CAIP) Policy, including a CAIP plan requirement, may apply to the contract resulting from this Request for Tender.

Tenderers are to note that the Draft Contract, CSIRORFT2025024 Attachment C Draft Contract, will be issued as an Addenda.
