This Approach to Market (ATM) invites Tenderers who hold eligible surface water entitlements in the Northern Murray—Darling Basin (Basin) to submit a Tender Response to sell their water entitlements (either whole or in part) to the Aboriginal Water Entitlements Program (Program) acting through the Department. Under this ATM, the Program is seeking to purchase up to 10 gigalitres (GL) of surface water entitlements across 4 catchments in the Northern Basin: • NSW Border Rivers. • QLD Border Rivers. • NSW Barwon Darling. • NSW Namoi. Water purchased through this Open Tender will remain in the consumptive pool and will be used to support Basin First Nations communities realise their aspirations for water ownership and achieve Cultural, social, economic, spiritual and environmental benefits. By submitting a tender, you are offering to sell the nominated volume of your water entitlement on the terms and conditions set out in the Draft Multi-Jurisdictional Sale Agreement. Further details about this procurement process can be found in clauses 2.2 and 2.3 of this ATM.

Conditions

• Only one water right to be the subject of each Tender Response. • Water right volume of 10?ML or more offered for purchase (Nominal Volume) against the water right. • The water right offered must be eligible as defined in clauses 2.3 and 2.4 of this ATM. • There is sufficient volume to meet the offer either available for sale and registered in the name of the Tenderer

Instructions

Applications must be made via an online Tender Response Form (Tender360). The Tender360 site is accessible from the link in the ATM document (at Schedule 1) on the AusTender website (available once the Tenderer has registered on AusTender). Tender Responses will be submitted through the completion of the Tender Response Form. In order to gain access to the Tender Response Form a Tenderer or their agent will first need to create a Tender360 account with a username and a password.
