Description

This Approach to Market (ATM) is for the establishment of a Standing Offer Arrangement for the provision of subsidised Alternative Dispute Resolution (ADR) services. The services will be made available to eligible parties engaged in resolving disputes through ADR processes such as mediation, conciliation, conferencing, case appraisal, neutral evaluation, or arbitration. The objective of this arrangement is to support small businesses in dispute with other businesses or government agencies to resolve disputes efficiently and constructively, without the need to pursue litigation through the courts. By providing access to subsidised ADR services, ASBFEO aims to enhance the capacity of small businesses to reach fair and timely resolutions.

Conditions

The Lead Customer will exclude a Response from further consideration if at any time before a Deed of Standing Offer is executed the Potential Supplier does not provide: a) a Valid and Satisfactory Statement of Tax Record by the Closing Time, or a receipt demonstrating that a Statement of Tax Record has been requested from the Australian Taxation Office by the Closing Time; and b) for any Subcontractor that the Potential Supplier proposes to engage to deliver Goods or Services with an estimated value of over $4 million (GST inclusive), a Valid and Satisfactory Statement of Tax Record for that Subcontractor. In any case, the Lead Customer will exclude a Response from further consideration unless the Supplier has provided all required Valid and Satisfactory Statements of Tax Record no later than 4 business days from the Closing Time and before the award of any contract, whichever is earlier, refer https://www.ato.gov.au/Business/Bus/Statement-of-tax-record/ for more information. The Lead Customer will also exclude from participation any Potential Supplier that does not have accreditation under the Australian Mediation and Dispute Resolution Accreditation System (AMDRAS), or equivalent accreditation for the type of ADR offered, that demonstrates comparable standards of training, assessment, and professional conduct. Evidence of AMDRAS accreditation or equivalent accreditation must be provided. Suppliers must maintain accreditation for the duration of the DoSO.
